Virginia DEQ Special Waste Permit Process
Why this matters
The Virginia Department of Environmental Quality (DEQ) regulates solid waste under the Virginia Solid Waste Management Regulations at 9 VAC 20-81 (general solid waste) and 9 VAC 20-60 (hazardous waste). The state has a distinctive "special waste" category that sits between routine solid waste and RCRA hazardous waste, regulated under 9 VAC 20-81-620 and the receiving facility's permit. A junk-removal company hauling certain waste streams in Virginia, including asbestos-containing material under regulated quantities, contaminated soils, sludges, large-volume industrial wastes, treated medical waste residues, and biosolids, must coordinate with the receiving facility on special waste acceptance procedures before delivery. Walking up to a Virginia DEQ-permitted landfill with a load of unidentified special waste and no pre-acceptance approval gets the load rejected at the gate and the operator drives back to the customer with a billable problem and no disposal route.
Special waste definition
Virginia DEQ regulations define "special waste" at 9 VAC 20-81-10 as solid waste that requires special handling, processing, or disposal because of quantity, concentration, physical or chemical characteristics. The receiving facility's permit specifies which special waste categories it can accept and under what conditions. Common categories include friable asbestos-containing material (regulated under both DEQ and EPA NESHAP at 40 CFR 61 Subpart M), petroleum-contaminated soils, dewatered industrial sludges, ash and incinerator residue, water treatment plant sludge, and large items requiring special handling (industrial equipment, boilers, drums). Each category triggers receiving-facility-specific acceptance procedures.
Step 1: Waste characterization
Before approaching a receiving facility, characterize the waste stream. For asbestos, this means a state-licensed asbestos inspector's report identifying the material as friable or non-friable, the asbestos content (PLM percentage), and the quantity. For petroleum-contaminated soil, this means analytical results showing concentration against the Virginia Voluntary Remediation Program risk-based screening levels under 9 VAC 20-160. For unknown wastes, characterization may require TCLP analysis under 40 CFR 261.24 or full RCRA characterization. The receiving facility will refuse uncharacterized material; the operator's first task is to gather the characterization documentation.
Step 2: Identify the receiving facility
Virginia DEQ maintains a list of permitted solid waste management facilities at deq.virginia.gov. Not every landfill or transfer station accepts every special waste category; the facility permit dictates the accepted streams. For asbestos, the receiving facility must hold a permit authorizing asbestos disposal (a subset of Virginia landfills). For contaminated soils, the receiving facility must hold a permit authorizing contaminated soil acceptance. Match the waste characterization to a facility that holds the matching permit before contacting the facility.
Step 3: Pre-acceptance notification
Contact the facility's environmental compliance manager (not the gate attendant) at least 5 business days before delivery. Provide: characterization documentation, generator name and VA generator ID, estimated quantity and load configuration (bulk, bagged, drummed, palletized), source site address, and proposed delivery date. The facility reviews against its permit and approves, requests more documentation, or refuses. Written approval (email is typical) is the authorization to deliver. Some facilities require pre-payment at this stage.
Step 4: Transport documentation
Transport with a shipping document or manifest that travels with the load. For asbestos: the Virginia DEQ asbestos waste shipment record, retained 2 years minimum under 9 VAC 20-81-620. For contaminated soils and industrial sludges: the pre-acceptance approval plus a bill-of-lading document showing origin, hauler, receiving facility, quantity, and characterization summary. The driver carries the documentation; the facility receives a copy at delivery and the generator retains a copy.
Step 5: Delivery procedure
Arrive during the facility's special waste window (restricted hours, not routine gate-receiving). Present pre-acceptance approval and transport documentation. The facility verifies documentation against the load, weighs, and either accepts or refuses. Refused loads cannot be left; the operator transports back at cost. Accepted loads receive a tip ticket with weight, special waste category code, and facility permit number, which is the proof of compliant disposal.
Step 6: Recordkeeping
Retain at least 3 years (longer for asbestos, lead, PCB streams): characterization documentation, pre-acceptance approval, transport documentation, tip ticket, and any certificate of destruction. Asbestos records retain 2 years minimum under 9 VAC 20-81-620; practical retention is longer because asbestos liability surfaces years later. PCB streams retain 3 years under 40 CFR 761.180.
Coordination with EPA NESHAP for asbestos
For asbestos, the Virginia DEQ process operates alongside EPA NESHAP at 40 CFR 61.145, requiring written notification to the state agency at least 10 working days before disturbing threshold quantities (260 linear feet thermal system insulation, 160 square feet surfacing, 35 cubic feet facility component) of regulated ACM. Notification is filed by the building owner or abatement contractor, not the junk-removal company. Verify the notification was filed before mobilizing.
Biosolids and treatment residues
Wastewater biosolids are regulated under 40 CFR 503 and 9 VAC 25-31. Treated medical waste residues are regulated under 9 VAC 20-120. These streams reach a junk-removal operator only when a specialty facility closes; full characterization is required before hauling.
Asbestos hauling in Virginia requires DEQ-recognized asbestos transporter status and the wet-sealed-bag protocol under 9 VAC 5-60 (state air pollution regulation referencing NESHAP). A junk-removal company that bags and hauls suspect asbestos material without the transporter authorization, without the receiving facility's pre-acceptance, and without the wet-bag and chain-of-custody documentation is operating outside the regulatory envelope and exposes principals to personal civil and criminal liability.
Common refusal triggers
Five conditions consistently trigger gate refusal: undocumented characterization, pre-acceptance approval missing or expired, load configuration mismatch (bulk delivered when bagged was approved), waste origin outside Virginia without interstate import authorization, and overweight loads exceeding the facility's per-vehicle capacity.
