Fence-Line Tree Removal Preparation
Why this matters
A fence contractor who removes a tree without a clear plan is one of the most common job-site liability sources in the trade. Trees on a fence line are almost always on someone's property; cutting "the tree on the line" can be felony timber trespass if the tree turns out to be the neighbor's. A tree dropped wrong takes out the new fence section the crew is about to install, the neighbor's deck, or the power drop to the house. A tree judged "safe to cut" by a fence crew that turns out to have a hollow trunk or a heavy lean snaps, kicks back, and kills the cutter. The contract math is brutal: a small in-scope tree removal done wrong has produced six-figure liability claims, a wrongful-death lawsuit, or a felony charge against the contractor. The right answer is almost always to sub it out, in writing, with the right insured arborist.
When the fence contractor should NOT cut the tree
If any of the following is true, do not cut. Sub the work to a licensed insured arborist or refuse the scope.
The tree is over 6 inches diameter at breast height (DBH) and within drop range of a structure, power line, or vehicle.
The tree is within 10 feet of any energized power line (FPL, utility distribution, or service drop). Tree work near power lines requires utility coordination per OSHA 29 CFR 1910.269 and almost always requires a line clearance qualified tree worker.
The tree shows obvious defects: lean, dead top, hollow trunk, large dead branches, fungal conks, or significant root damage.
The tree's ownership is ambiguous. A tree with its trunk on the property line is jointly owned in most states; cutting requires written consent from both owners. A tree with its trunk on one side of the line but branches crossing the line is solely owned by the trunk-side property regardless of where the branches grow.
The tree is regulated (heritage tree, protected species, mitigation tree, conservation easement). Many municipalities have heritage tree ordinances requiring permit for removal of trees over a certain size.
The customer asks you to cut without written permission from the actual tree owner.
The contractor who cuts in any of these conditions is exposed personally and corporately. Sub it out.
Pre-removal documentation
When the tree removal IS in scope, document before any saw is started.
Survey or property line marked: a recent survey, or stakes set by a licensed surveyor, or a clear physical line agreed in writing by the adjacent property owners. "We always thought the line was there" is not documentation; it is the start of a quiet-title lawsuit.
Tree ownership confirmed: trunk location relative to the line. Written consent from the tree owner if the tree is on a neighbor's parcel or jointly owned. The consent must be specific (tree at GPS coordinates or marked with a unique tag) and dated.
Photos: tree before removal, defects visible, surrounding structures, fence line, neighbor's property within drop range, overhead power lines, underground utility marks.
Utility locate: 811 ticket pulled at least 2 working days before any equipment touches ground. The locate covers digging for stump grinding and any post-hole work that follows tree removal. Even if the fence trench is unrelated to the tree, do the locate now.
Drop zone clearance: identify the planned drop direction, secondary drop direction if the tree falls wrong, escape paths for the cutter (always two paths, 45 degrees back from the cut, opposite the planned drop direction).
Tree assessment
If the work is in your scope and the tree is small enough to justify in-house removal, the cutter assesses:
Lean direction. Use a plumb-bob or a clinometer. A tree leaning 5 degrees from vertical wants to fall in the lean direction; fighting that lean with a back cut and a wedge works up to maybe 10 degrees, beyond that the tree wins.
Crown weight distribution. Look up. A tree with most branches on one side is weighted to that side; the drop will favor that side regardless of cuts.
Trunk soundness. Sound the trunk with the back of an axe or a steel rod. A hollow trunk gives a different tone than solid wood; cutting a hollow tree is a known killer because the cut destabilizes a hollow column and the tree can collapse straight down or twist.
Surrounding hazards. Other trees within drop range that could be hit by the falling tree and rebound onto the cutter. Hung-up potential where a falling tree gets caught in branches of an adjacent tree (hung-up trees are the single most dangerous condition in production logging; the cutter has to figure out how to bring it down without it falling on him).
Wind. Above 10 mph wind, halt the cut. Wind during the fall shifts the drop direction unpredictably.
Cutting sequence (notch and back cut)
For trees within in-house capability (no more than 6 inch DBH for crews without arborist credentials, and no more than 12 inch DBH for those with limited tree-removal experience):
Notch cut on the drop-direction side. The notch is two cuts forming a wedge: a level bottom cut and an angled top cut meeting at the same line. The notch opens at 45 to 90 degrees and is cut to a depth of 1/4 to 1/3 the tree's diameter. The hinge wood between the notch and the back cut is what controls the fall.
Back cut from the opposite side, at a level slightly above the bottom of the notch. Stop the back cut when the hinge thickness reaches roughly 10 percent of the tree's diameter (more for hardwood, less for softwood). The hinge wood snaps as the tree falls, controlling direction.
Wedges driven into the back cut as it opens to push the tree in the drop direction if needed.
Escape: when the tree starts to fall, the cutter walks (not runs) on the pre-planned escape path. Saw in front of the cutter, ready to defend against a kickback or a falling branch.
For any tree beyond this in-house capability, hire a tree service.
A tree dropped onto the new fence the crew is about to install destroys the fence and damages the crew's reputation. ALWAYS drop the tree BEFORE staging fence materials in the drop zone. If the drop zone covers the planned fence line, drop the tree FIRST, clean up the debris, then layout the fence. A tree dropped onto a stack of fence pickets is also a tree dropped where the cutter staged his exit; the kickback hazard is real.
Stump and root handling
The stump remains after the tree comes down. Three handling options:
