OSHA 1926 Subpart L Scaffolds For Two-Story Residential
Why this matters
When the ladder will not reach safely and the water-fed pole cannot reach the angle, the next tool is supported scaffold. OSHA 29 CFR 1926 Subpart L is the construction-scaffold rule, and it applies the moment a window cleaner erects supported scaffold on a residential job - the residential exemption that some trades claim does not cover scaffold use. This article gives the components, the load rating, the fall-protection trigger height, and the competent-person rule that an OSHA inspector will ask about if they walk up to your job site.
Scope of Subpart L
Subpart L (29 CFR 1926.450 through 1926.454) covers all scaffolds used in construction work, including supported scaffolds (frame, tube and coupler, mobile), suspended scaffolds (swing stages), and aerial lifts treated under Subpart L for fall-protection purposes. For two-story residential window cleaning, the relevant configurations are:
- Frame scaffold (Baker / utility scaffold) - rolling base, one or two tiers.
- System scaffold - modular rosette system for irregular elevations.
- Pump-jack scaffold (1926.452(j)) - paired wood or aluminum poles with pump-jack brackets, used on residential siding and trim, occasionally adopted by window cleaners for long elevations.
Load capacity (1926.451(a))
Every scaffold and its components must support its own weight plus 4 times the maximum intended load. Three duty ratings:
- Light duty - 25 lb/ft^2 (window cleaners working with hand tools and a 5-gallon bucket fall here).
- Medium duty - 50 lb/ft^2.
- Heavy duty - 75 lb/ft^2.
A 7-foot plank rated 25 lb/ft^2 at light duty supports about 500 lb of distributed load including planks. For the 4x safety factor, the structural members and connectors must be rated for 2,000 lb total. Verify the scaffold tag matches your intended load before standing on it.
Platform construction (1926.451(b))
The working platform must be fully planked between front uprights and guardrails. Gaps over 1 inch require closure. Scaffold-grade planks are graded by lumber association (e.g., Southern Pine Inspection Bureau) and stamped accordingly; do not substitute 2x10 home-center lumber unless the lumber stamp indicates scaffold grade. Planks must extend over their end supports by at least 6 inches and not more than 12 inches (or be cleated).
Fall protection (1926.451(g))
Fall protection is required on scaffolds with a working platform more than 10 feet above a lower level. Two acceptable means:
- Guardrail system - top rail 38 to 45 inches high (2010 update raised the range), midrail, and toeboard. Top-rail strength: must support 200 lb in any outward or downward direction without exceeding 39 inches height.
- Personal fall-arrest system (PFAS) - full-body harness, shock-absorbing lanyard, anchor rated to 5,000 lb per worker, fall-arrest distance calculated to ensure no contact with a lower level.
A typical 2-story residential window-cleaning Baker scaffold tops out around 12 to 14 feet working height and is above the 10-foot trigger. Guardrails or PFAS, not both optional.
Access (1926.451(e))
Climbing the cross braces of a frame scaffold to reach the platform is not permitted - it is a frequent OSHA citation for residential trades. Acceptable access: built-in ladders integral to the scaffold frame, attached ladder rungs (with the standoff brackets that accept them), portable ladder secured to the scaffold, or a ramp/walkway. Mobile (rolling) scaffold also requires that the wheels be locked before climbing on the structure.
Competent person (1926.451(f)(3) and 1926.454)
A "competent person" (one capable of identifying hazards and authorized to correct them) must inspect the scaffold and its components before each work shift and after any event that could affect structural integrity (1926.451(f)(3)). Training requirements (1926.454):
- Nature of electrical, fall, and falling-object hazards in the work area.
- Correct procedures for dealing with electrical hazards.
- Use of fall-protection and falling-object protection systems.
- Proper use of the scaffold and handling materials on it.
- Maximum intended load and the load-carrying capacities.
Document the training. An OSHA inspector who finds an undocumented worker on an erected scaffold writes a serious citation.
Pump-jack scaffold (1926.452(j)) was specifically restricted in the 1996 Subpart L rewrite - pump-jack poles cannot exceed 30 feet, brackets must be metal (no wood brackets), and the working load is limited to 500 lb. Window-cleaning crews adapting pump-jack systems for high reach must verify the install against 1926.452(j) before climbing.
Practical decision tree
For a 2-story residential window-cleaning job with eaves at 18 to 22 feet:
- Water-fed pole from ground - first choice, no scaffold needed.
- Extension ladder, tied off, with stand-off - acceptable if work is single-window and within 4-to-1 setup geometry.
- Baker scaffold inside (for stairwell windows) or outside (for tight-against-house elevations) - go to scaffold when ladder positioning forces overreach or the work cycle is longer than 30 minutes at one position.
- Aerial lift (scissor or boom) - for commercial / multi-tenant residential where access is straightforward and rental cost is justified.
