Texas TCEQ Class I vs Class II Aerobic OSSF Permit Requirements
Why this matters
Texas TCEQ Chapter 285 (30 TAC 285) classifies on-site sewage facilities (OSSFs) by treatment level, not by tank shape. Class I and Class II are the two aerobic classifications most installers run into, and they trigger different design submittals, different installer license tiers, and different maintenance contract obligations. A crew that quotes a Class I aerobic spray field on a lot that needs Class II surface application (or vice versa) gets the permit kicked back by the local Authorized Agent and loses the deposit. This reference is the field-level cheat sheet on which is which, when each applies, and what paperwork moves with each.
TCEQ Chapter 285 - the overall structure
30 TAC 285 governs all OSSFs in Texas, delegated through TCEQ to county-level Authorized Agents (typically the County Health Department or the County Designated Representative). Permits are issued at the county level; the state defines the rules. The 2023 amendments to 285 carried through a clarification of the difference between aerobic Class I and aerobic Class II disposal but left the underlying treatment-class definitions intact.
The classes a residential installer encounters:
- Standard subsurface (conventional) - septic tank + soil absorption. No aerobic component.
- Class I aerobic - secondary treatment to a level meeting 30 TAC 285.32(c). Disposal is typically subsurface drip or low-pressure dosing.
- Class II aerobic - secondary treatment to a higher disinfection standard. Disposal is via surface application (spray heads).
- Non-Standard / Engineered - any design that does not match a pre-approved configuration; requires a registered professional engineer (P.E.) to design and submit.
Class I aerobic
Class I aerobic systems produce effluent that meets the secondary-treatment standard but are NOT permitted for surface spray application. Effluent must go subsurface - drip irrigation per 285.33(d)(2), pressure-dosed gravel drainfield per 285.33(d)(1), or chamber laterals.
When Class I is the right answer:
- Subsurface disposal is feasible (soils accept effluent at the design loading rate).
- The lot is large enough for a subsurface system but soil quality is borderline (Class Ia, Ib soils per 285.30).
- The owner does not want sprinkler heads visible in the yard.
Disinfection is NOT required for Class I subsurface disposal. The treatment system (typically a Norweco Singulair, AquaKlear, Hoot, or Delta ECOPOD) outputs effluent that meets the secondary standard, and the soil column provides the final disinfection.
Installer license required: OSSF Installer II (formerly Class II Installer) for any aerobic system. The Installer II license is issued by TCEQ under 30 TAC 30, Subchapter F.
Class II aerobic
Class II aerobic systems produce effluent that meets a more stringent disinfection standard suitable for surface application via spray heads. The defining feature is the disinfection step - typically a chlorine tablet feeder (Bio-Pure, Norweco bio-static feeder) or a UV disinfection unit (Norweco Bio-Kinetic UV).
When Class II is the right answer:
- Lot is too small or soils too poor for any subsurface field.
- The home has been built and the only feasible disposal is surface spray.
- Owner specifically wants spray application (some HOA / aesthetic reasons).
Class II carries additional homeowner-facing obligations:
- Permanent maintenance contract with a licensed maintenance provider (separate license from installer; the Maintenance Provider license under 30 TAC 30, Subchapter F).
- Quarterly inspections required by 285.91(4) for the first 2 years, then per the local Authorized Agent's policy (most counties keep the quarterly cadence indefinitely).
- Disinfectant tablets must be NSF/ANSI 50-listed for wastewater (not pool tablets - this is the most common compliance failure).
- Spray heads must be set back from the property line and dwellings per 285.33(b) - typically 10 feet from property line, 20 feet from dwelling, and 50 feet from a water well.
Permit submittal differences
For Class I:
- Site evaluation by a registered Site Evaluator or P.E. (soil profile, percolation if applicable).
- Planning materials per 285.4 - lot survey, design flow calculation, tank sizing, drainfield layout.
- Manufacturer's submittal package for the aerobic treatment unit (the TCEQ-approved NSF/ANSI 40 unit).
- Subsurface disposal design - drip layout or LPD trench layout.
- Installer II license number on every page.
For Class II, all of the above plus:
- Spray field design - head selection, head spacing, area coverage map.
- Disinfection method specification (tablet feeder model + tablet type, OR UV unit model + bulb life).
- Maintenance contract with a licensed Maintenance Provider, signed by the homeowner, dated within 30 days of permit submittal.
- Operating and Maintenance handbook for the homeowner (per 285.7).
Setback requirements (the lookup nobody memorizes correctly)
Setbacks from 285.91(10) for both Class I and Class II:

Class II spray area setbacks from the dwelling are larger than Class I subsurface because the spray creates an aerosol exposure pathway. Counties commonly add local setbacks on top of the state minimum.
Maintenance contract obligations
For Class II (mandatory) and Class I aerobic (encouraged, sometimes required by local Authorized Agent):
- Initial contract is 2 years per 285.91(4), renewable.
- Quarterly inspections must include effluent quality observation, mechanical component check, disinfection refill / verification, and homeowner education.
- Reports must be submitted to the local Authorized Agent (usually within 30-60 days of inspection - county-dependent).
- The licensed Maintenance Provider, NOT the homeowner, is on the hook for reporting non-functioning components to the Authorized Agent within 14 days.
