Commercial Property Arborist Inspection Liability Cycle

Why this matters

A commercial property owner has a legal duty to inspect trees on the property for hazards and a documented standard of care to discharge that duty. The standard arises from common-law premises liability and is codified in many jurisdictions as a duty to discover and abate known or reasonably-discoverable hazards. When a tree fails and damages a vehicle, a person, or a structure, the owner's first defense is the documented inspection cycle: who inspected, when, what was found, what was recommended, what was done. A tree service contractor who can stand up that inspection program for a portfolio of properties (office park, apartment community, HOA, school district, municipality) is selling the owner a liability shield, not a tree trimming. This SOP is the program.

Standard of care

The ANSI A300 Part 9 standard, Tree Risk Assessment, defines the methodology for systematic tree risk assessment in the US. The ISA Tree Risk Assessment Qualification (TRAQ) is the credential. ANSI A300 Part 9 establishes three levels of assessment:

  • Level 1 Limited Visual: walk-by from a vehicle or sidewalk, covering a large area quickly.
  • Level 2 Basic: walk-around 360-degree visual on each tree, with binoculars and a probe.
  • Level 3 Advanced: instrumented assessment (resistance drilling, sonic tomography, root crown excavation) on flagged trees.

The standard inspection cycle for commercial property is Level 2 on a documented routine (annual minimum, semi-annual on high-target properties), with Level 3 on flagged trees only.

Inspection cadence by property type

  • Office park or corporate campus: annual Level 2 in late winter (deciduous defect visibility) plus post-storm spot inspection within 14 days of a wind event exceeding 50 mph or an ice event with measurable accretion.
  • Apartment community or HOA: annual Level 2, with focused re-inspection on any tree within striking distance of a building entrance, playground, pool deck, or designated walkway.
  • School district: annual Level 2 plus monthly walk-by during school session of any tree within striking distance of a playground or bus loop.
  • Municipal park or right-of-way: cycle dictated by the municipality's urban forestry plan, typically Level 1 of the whole inventory every 3 years and Level 2 of high-target zones annually.

Target rating and risk matrix

ANSI A300 Part 9 uses a likelihood-times-consequences matrix:

  • Likelihood of failure: improbable, possible, probable, imminent.
  • Likelihood of impact: very low, low, medium, high (a function of target occupancy rate; a parking lot is high, a back fence at a wooded property line is low).
  • Consequences of impact: negligible, minor, significant, severe (a function of what the target is; a parked car is significant, a person is severe).

The matrix yields a risk rating of low, moderate, high, or extreme. The inspector's report assigns each flagged tree a rating and a recommended action (monitor, mitigation pruning, target removal, tree removal).

Documentation that survives a deposition

The deliverable is a written, signed, dated report with:

  • Tree inventory: each tree given a unique tag number (paint-stenciled, aluminum tag, or GPS coordinate), species, diameter at breast height (DBH), height estimate, condition rating.
  • Defect catalog: cavity, included bark, cracked union, root plate disturbance, lean change, dieback percentage, mushroom fruiting body, decay column.
  • Risk rating per tree.
  • Recommendation per flagged tree, with priority (immediate, within 30 days, within 12 months, monitor next inspection).
  • Inspector credentials: ISA TRAQ number, ISA Certified Arborist number, signature, date.
  • Photographs of every flagged tree.

Keep the report for the statute of limitations on premises liability (varies by state, typically two to six years for personal injury, longer for property damage in some jurisdictions). The owner keeps the same documents in the property file.

Liability allocation in the contract

The inspection contract should be clear on three points:

  • The inspection is a professional opinion at a point in time. Trees fail between inspections.
  • The contractor's recommendation list is delivered to the owner; execution is the owner's decision and on the owner's timeline.
  • If the owner declines a recommended mitigation, the declination is documented in writing (an email reply is sufficient) and the contractor is released from liability for failure of that specific tree.

The contractor's professional liability (errors and omissions) policy covers the inspection opinion. The contractor's commercial general liability covers the tree-care work. Carry both; the property manager's COI request will list both.

Pricing structure

Inspection contracts price per tree inspected (for a per-tree fee on a defined inventory) or per visit (lump-sum for a defined property). Per-tree pricing scales cleanly across portfolios and aligns the contractor's revenue with the work. Per-visit pricing is simpler for small properties.

The mitigation work (pruning, removals, cabling) is a separate contract or change order; quote off the inspection report.

Verbal recommendations are not documentation. If the property manager calls in March asking what you found and you do not have a written report dated March, the depositions in 2028 over a tree failure in November will not go your way. Reports are written, signed, dated, and emailed with a delivery receipt.
