Egress vs Non-Egress Bedroom Window Decision Tree
Why this matters
Egress is the highest-stakes code requirement in window replacement work. The IRC R310 emergency escape and rescue opening requirements apply to every sleeping room and every basement with habitable space, and replacing a code-compliant egress window with a smaller or differently-operating unit can violate code, void insurance, and create a real fire-escape hazard. The senior installer who quotes a "match the existing size" replacement without checking R310 against the current window's compliance is one inspection away from a stop-work order. The estimator who insists on egress conversion where the existing was grandfathered burns the customer's budget. This tree walks the call from "what's the existing window" to "what does R310 require here, today."
Symptom presentation - the four call types
You arrive at one of four scenarios. First, customer wants to replace existing bedroom or basement windows like-for-like. Second, customer is finishing a basement and wants to add a bedroom, triggering a new egress requirement. Third, customer is converting a non-bedroom to a bedroom (office to bedroom for a growing family, basement family room to bedroom). Fourth, inspector has flagged an existing non-compliant window during a real-estate transaction or permit inspection. Each starts at a different question.
Quick checks at the site walk
- Identify every room currently used or proposed to be used as a sleeping room. IRC R310.1 requires emergency escape and rescue opening in every sleeping room. "Basement bedroom" includes basement spaces marketed or used for sleeping even if originally permitted as something else.
- Measure existing window net clear opening (the actual opening when the sash is fully open). IRC R310.2.1 minimum: 5.7 sq ft net clear opening (5.0 sq ft for grade-level openings per R310.2.1 exception), minimum 24 inches height, minimum 20 inches width, sill height maximum 44 inches above the floor.
- Confirm window operation type. Single-hung and double-hung: net clear opening is bottom sash open at top - only the bottom half counts. Casement: full sash opening. Awning and hopper: full opening minus sash thickness. Slider: half the total window opening.
- Identify when the existing window was permitted. Pre-1990s installations in many jurisdictions predate strict egress enforcement. Existing non-conforming windows are sometimes grandfathered under prior code unless a permit triggers re-inspection.
- Pull AHJ adoption cycle. Current AHJ on 2018, 2021, or 2024 IRC affects egress specifics. 2018 R310 added the requirement that ladders for window wells must support 300 lb live load; 2021 clarified sill-height measurement; 2024 carried forward.
Isolation tree - egress required or not
Branch 1 - existing sleeping room with existing window meeting R310 (sufficient net clear opening, sill height under 44 inches, operable from inside without keys or tools). Replacement must meet or exceed the same dimensions. Replacement window's net clear opening must equal or exceed the existing. Many builder-grade double-hung replacements have smaller net clear opening than the original (frame thicker, sash narrower) - verify with the manufacturer's specs.
Branch 2 - existing sleeping room with existing window NOT meeting R310 (small opening, high sill, fixed sash). Replacement must bring the opening to code if the project is permitted. AHJ practice varies: some require code-compliant replacement on every permit, others grandfather existing geometry if the replacement is in-kind. Pull the AHJ's written policy.
Branch 3 - new basement bedroom or converted bedroom. R310 applies fully. Window must meet 5.7 sq ft net clear (5.0 sq ft for grade-level), 24 inch min height, 20 inch min width, 44 inch max sill from floor. Basement windows below grade require a window well per R310.2.3: 9 sq ft area, 36 inches projection from wall, ladder if well depth exceeds 44 inches.
Branch 4 - basement window in a non-sleeping room (storage, mechanical, half-bath). R310 does not apply. Window may be any size that meets the building's other requirements. Useful when budget is tight and the customer commits in writing that the space will not be used for sleeping.
Branch 5 - grandfather question on an existing non-conforming bedroom window. AHJ specific. Some AHJs allow continued use of existing non-conforming windows until a building permit is pulled for any related work. Other AHJs require compliance upgrade at any window replacement permit. When in doubt, quote both options (in-kind non-conforming replacement vs code-compliant replacement) and let the customer choose with full understanding of the risk.
Confirming diagnosis - the net clear opening math
The math trips most installers. Net clear opening is calculated from the actual sash-open dimensions, not nominal window size. For a 36 x 60 double-hung:
- Bottom sash open at top: clear opening height is approximately half of 60 minus sash thickness minus weatherstrip - typically 27 to 29 inches.
- Clear opening width is the inside-of-jamb dimension minus stop - typically 32 to 33 inches.
- Net clear area: 27 x 32 = 864 sq in = 6.0 sq ft - meets R310 5.7 sq ft minimum but only barely.
A 32 x 60 double-hung gets only ~5.0 sq ft net clear opening at the same calculation - meets R310 only under the grade-level exception (R310.2.1 exception for openings at grade), not for upper floors. The estimator who specs a "30 x 60" or "32 x 60" on a second-floor bedroom and calls it egress-compliant has missed.
For casement windows, the calculation is cleaner: opening is sash dimension. A casement with 22 x 38 sash gives 5.8 sq ft - meets R310 with margin.
Confirming diagnosis - the sill-height check
R310.2.2 limits the sill height to 44 inches above the floor. Standard double-hung installation puts the sill at 32 to 36 inches above the floor on a typical residential elevation. Some new windows have different sill heights based on the frame design - verify the as-installed sill height before ordering, especially when retrofitting a different operation type (casement to slider, etc.).
